By using our website, placing an order and or by registering on the website you agree to be bound by the following terms and conditions. These terms and conditions have been designed in the spirit of fair play. We reserve the right to change these terms and conditions from time to time as required by updating this page
1.0 The Wine Room Customer Promise
1.1 If you don't like a wine you don't pay. If you buy any of our wines and you don't like a particular bottle, just let us know as soon as possible and we will credit you for that bottle. At the time, we will let you know if the wine is also to be collected.
If you have bought a whole case of one particular wine that you do not like, provided that you have only drunk one bottle from the case, we will collect the remaining bottles and refund you the price of the case. All wine to be collected must be unopened and in original, saleable condition.
1.2 If you find a wine cheaper elsewhere. If you buy a wine from us and then find the same wine for sale anywhere in Australia at a cheaper unconditional price within 30 days, we will refund the difference. Simply email, mail or fax us a copy of the advertisement or let us know where and when you saw the wine advertised at a cheaper price.
1.3 Guaranteed delivery. If you live within a metropolitan area, we can deliver within 5-7 working days, usually faster. Outside of that, depending on where you live, delivery can take between 10-16 working days to other areas of Australia. In outlying areas delivery will be made to your local agent. 1.4 If you happen to be out when we deliver. We normally deliver Monday to Friday, 9.00am to 5.00pm and can deliver to either your office or home. When you place your order, provide us with instructions as to where we can leave your order if you are not there when we deliver (e.g leave at the back door). Our drivers will follow your instruction and will try to find a safe place to leave your wine. However if it does get stolen we will replace it or give you a refund as required (see 1.5 below).
1.5 Stolen Wine and Breakages.
1.51 If you give secure instructions for us to leave your wine, for example, outside your back door and the wine gets stolen, providing we still have the wine available, we will send you a replacement free of charge. If the wine is not available, we will refund any charges for the wine. When a replacement case is sent, we reserve the right to request a change in delivery instruction to a more secure delivery location or request a customer signature.
1.52 Our carriers normally do not deliver cases with broken bottles and will notify us to arrange a replacement for you on the rare occasion this happens. If, however, you do receive a case with broken bottles, please contact us as soon as you receive the wine (within 30 days of the invoice date) at enquiries@thewineroom.com.au or call 1300 550 701.
We will happily replace or refund any breakages that have occurred in transit. Once the wine has been delivered in accordance with the original delivery instructions, please note that all risk of damage or loss to the wine passes to you. Even though the risk of damage or loss has passed to you, please note that you will not own the wine until you have paid us for the wine in full.
1.6 Availability All wines are sold on the basis of while stocks last. We always endeavour to have sufficient stock to meet demand, however, there may be occasions when we run out of some wines offered. When this does occur we will usually select wines of at least equal quality (if not better) to offer as an alternative. All wines are covered by our Customer Promise, so if you don't like the wine you don't pay. See 1.1 above.
1.7 Claiming under our Customer Promise. Should you need to claim under our Customer Promise or are not sure what to do to claim, notify us by email on enquiries@thewineroom.com.au or call us on 1300 550 701.
1.8 Fair Play Policy. If we reasonably believe that a customer has breached these terms and conditions or has abused our Customer Promise policy, we reserve the right in our absolute discretion to suspend or cancel the Customer Promise policy in relation to that customer, to cancel a particular order made by the customer or to close that customer's account.
2.0 Age restriction
2.1. The Wine Room operates under South Australian Special Circumstances Licence number 51205679. Under Australian law, alcoholic beverages can only be sold or supplied to persons aged 18 years or over. By placing an order you confirm that you are at least 18 years old.
2.2 If you are buying a case of wine as a gift - the recipient must also be over 18 years of age.
2.3 Our drivers will request some form of ID if there is any doubt about the age of the recipient on delivery. If the person receiving delivery of the wine is unable to produce appropriate ID, unfortunately, our couriers cannot leave the wine.
3.0 Prices and payment
3.1 All prices are quoted in Australian dollars, and may be per bottle or per case, as indicated. The prices include Goods and Services Tax, unless otherwise specified. Any delivery charges are additional. You must pay all amounts owing to us by credit card at the time you order the wine. If your credit card details are invalid or the purchase transaction is not approved by the financial institution responsible for your credit card, we may without liability, terminate that order.
3.2 We accept payment by Visa, MasterCard, Diners and Amex.
3.3 We reserve the right to terminate any special offer at any time, without notice.
4.0 Returns
4.1 Returns for claims under the Customer Promise, Breakages or Quality may require return of part of or the entire case.
4.2 We must be notified of any returns or breakages within 30 days from delivery. Notify us by email on enquiries@thewineroom.com.au, call us on 1300 550 701 or advise us by writing to The Wine Room, Corner Barossa Valley Way and Siegersdorf Road, Tanunda SA 5352.
4.3 All refunds and reimbursements under clause 4.1 will be raised within 30 days of receipt of your notification to return wine, provided the wine has been collected by our carrier.
4.4 Any wines collected by our courier must be in their original box, in saleable condition and packed to avoid further breakages.
5.0 Cancellations
5.1 You may cancel your order for any reason whatsoever at any time up to 7 working days from the day after the date you receive your wine, provided all of the bottles are unopened and in original and saleable condition.
5.2 To cancel your order call us on 1300 550 701 or notify us by email on enquiries@thewineroom.com.au or in writing to The Wine Room, Corner Barossa Valley Way and Siegersdorf Road, Tanunda SA 5352.
5.3 Any payments made for the order will be reimbursed within 30 days from the date we receive notification of the cancellation. It is your responsibility to keep the wine in a safe place and take reasonable care of it until it is collected.
6.0 Vouchers
6.1 If you have a voucher to redeem against the purchase of wine from us, the terms and conditions on that voucher apply, and you agree to be bound by those terms and conditions.
6.2 Vouchers are non-transferable and may not be sold or redeemed for cash.
7.0 Security
7.1 We use secure servers with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information. Additionally, we have security measures in place to protect our customer database and access to this database is restricted internally. For more information on security, click here.
7.2 It is your responsibility to protect your password from being disclosed to any third party.
8.0 Intellectual Property Rights
8.1 Copyright
(i) You agree and acknowledge that we own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site.
(ii) You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
(iii) All content included on this site, such as text, graphics, logos, button icons, images and software, is owned by or licensed to The Wine Room, operated by Cellarmasters Wine Pty Limited, ABN 950 767 279 49) or its content suppliers and is protected by international copyright laws.
(iv) Any improper use, including but not limited to the reproduction, modification, distribution, transmission, republication or display of the content on this site is strictly prohibited.
8.2 Trade marks
The Wine Room and www.thewineroom.com.au are trade marks of Cellarmaster Wines Pty Limited (ABN 950 767 279 49) in Australia and should not be used by any other party without the express permission of Cellarmaster Wines Pty Limited.
8.3 Disclaimer
The Magill Cellars label is in no way associated with Penfolds Magill Estate brand.
"thewineroom.com.au" has no affiliation with The Wine Room liquor outlets in Brisbane.
10.0 Limitation of liability
10.1 We warrant that the wines will be of satisfactory quality and fit for their general purpose. However you acknowledge and agree that all implied conditions and warranties on the part of The Wine Room in relation to any ordered goods supplied by The Wine Room are excluded to the maximum extent permitted by law. In respect of any liability which The Wine Room cannot exclude, The Wine Room liability is limited, at its option, to the replacement, repair or resupply of the ordered goods, or a refund of the cost of the ordered goods.
10.2 Customers should also be aware of the following inherent risks and warnings:
(i) Alcohol should be consumed in moderation.
(ii) A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
(iii) Red wine in particular may cause staining if spilt so extra care should be taken.
10.3 Sparkling wines and champagnes can be volatile due to the build up of gasses. Extra care should be taken when opening these.
11.0 Privacy Policy
11.1 Your privacy is important to us. The Wine Room do not sell, rent, trade or rent your personal information. By providing your details to The Wine Room on our web site, you consent to The Wine Room maintaining, recording, holding and using the information you give The Wine Room at the time of ordering to process your orders, to improve our service to you and inform you of promotions. 12.0 General
12.1 If we are prevented from carrying out any of our obligations by reason of events beyond our control, we shall be excused from complying with our obligations whilst such event persists, and, at our option, may elect to cancel any order without liability in such circumstances. We shall endeavour to promptly notify you if any such circumstances arise.
12.2 The Vienna International Sales Convention (as applied by the Sale of Goods (Vienna Convention Act) shall not apply to this contract.
12.3 This site is created and controlled by The Wine Room, owned and operated by Cellarmaster Wines Pty Limited in the State of South Australia. As such, the laws of the State of South Australia will govern these terms and conditions. We reserve the right to make changes to our site and these disclaimers, terms and conditions at any time.
